Short-Term Disability benefits equal 70% of your salary, up to $1,000 a week. If you are able to work part time but have lost at least 20% of your earnings, the disability benefit will compensate you for up to 70% of the wages you've lost up to $1,000 a week.
In most cases, these benefits are paid directly to you. However, if your salary continues while you are disabled, benefits are paid to your employer. You cannot receive full salary and disability benefits at the same time.
Benefits are also reduced by any amount you may receive from:
- Workers' Compensation or similar provisions in the law
- State disability benefits
- Social Security benefits
- A third party by judgment, settlement or otherwise (after subtracting attorney's fees)
Benefits are not paid when the disability is:
- not under the care of a doctor
- caused by war or act of war, either declared or undeclared
- due to intentionally self-inflicted injuries
- a result of active participation in a riot
- due to participation in a crime or misdemeanor
Benefits are paid weekly, starting on the 31st day of disability and are paid up to 52 weeks. Your disability must be certified by claims representatives periodically during that time.
